Overview

Gymex Fitness Ltd ("Gymex", "we", "us", or "our") respects the intellectual property rights of others and expects users of the Gymex Fitness app and website to do the same. We respond to notices of alleged copyright infringement that comply with the U.S. Digital Millennium Copyright Act (DMCA) and comparable laws in other jurisdictions.

Gymex hosts content submitted by users, including community posts, comments, shared workout programs, progress photos, and profile content. If you believe any such content infringes a copyright you own or control, you may ask us to remove it using the process below.

How to Report Infringement

To report content you believe infringes your copyright, send a written notice ("Takedown Notice") to our Designated Agent at the contact details in the Designated Agent section. Your notice must include all of the information described below so we can act on it.

Upon receiving a valid notice, we will remove or disable access to the allegedly infringing content, notify the user who posted it, and, where appropriate, give that user the opportunity to submit a counter-notification.

What a Notice Must Contain

To be valid under the DMCA (17 U.S.C. § 512(c)(3)), your Takedown Notice must include:

  1. A physical or electronic signature of the copyright owner or a person authorised to act on their behalf.
  2. Identification of the copyrighted work claimed to have been infringed (or a representative list, if multiple works are covered by a single notice).
  3. Identification of the material that is claimed to be infringing and that is to be removed, with enough detail for us to locate it (for example, a screenshot, the username, and a description of where it appears in the app).
  4. Your contact information — name, mailing address, telephone number, and email address.
  5. A statement that you have a good-faith belief that the disputed use is not authorised by the copyright owner, its agent, or the law.
  6. A statement, made under penalty of perjury, that the information in your notice is accurate and that you are the copyright owner or authorised to act on the owner's behalf.

Counter-Notification

If your content was removed and you believe it was removed in error or that you have the right to use it, you may submit a counter-notification to our Designated Agent. A valid counter-notification must include:

  1. Your physical or electronic signature.
  2. Identification of the material that was removed and the location where it appeared before removal.
  3. A statement, under penalty of perjury, that you have a good-faith belief the material was removed as a result of mistake or misidentification.
  4. Your name, mailing address, and telephone number, and a statement that you consent to the jurisdiction of the appropriate court and will accept service of process from the party who filed the original notice.

If we receive a valid counter-notification, we may restore the removed content in 10 to 14 business days unless the original complainant notifies us that they have filed a legal action seeking a court order to keep the content down.

Repeat-Infringer Policy

Gymex maintains a policy of terminating, in appropriate circumstances, the accounts of users who are determined to be repeat infringers. Accounts that are the subject of repeated valid infringement notices may have community access revoked or the account suspended or permanently terminated, consistent with our Terms of Service.

Misrepresentation

Please note that under Section 512(f) of the DMCA, any person who knowingly materially misrepresents that material is infringing, or that material was removed or disabled by mistake or misidentification, may be liable for damages. Do not make false claims.
